Can I Sue the NHS?

Unfortunately, many people suffer medical or clinical negligence whilst under the care of the NHS including surgeons, GP's, nurses and dentists. At Smart Assist we will give you a free assessment of your case in complete confidentiality.

Many people suffer in silence or due to poor advice never claiming the compensation for suffering that they are legally entitled to.

We will discuss your claim in complete confidence and with no obligation. To establish whether clinical negligence (sometime called medical negligence) has occurred, certain information is required and our solicitors have the knowledge and expertise to help you obtain it. These are:

  1. Establishing a duty of care

  2. Breach of that duty of care towards you

  3. The breach of duty caused your injury/illness

'I feel like I'm talking to a brick wall'.

In our experience Client's often experience difficulties with the Health Trust as soon as they make a complaint. This can result in a lack of response to phone calls, letters and/or emails and when a response is eventually received it is complicated and full of jargon. If this is happening to you, you will need the help of a professional solicitor with experience of NHS processes and procedures.

What is 'Duty of Care'?

Within English law, duty of care is defined as "an individual who may be owed a duty of care by another, to ensure that they do not suffer any unreasonable harm or loss". It is therefore usually very easy for our solicitors to establish that the duty of care was with the NHS when something goes wrong and when you enter the care of the NHS they have a duty to look after you.

Breach of the Duty Of Care

Once you have established a duty of care, before you can sue the NHS you must prove that this duty has been breached. Example could include removal of the wrong toenail or a negligent operation causing further injury. It might also include failing to take action such as keep the hospital clean of 'Super bugs'.

You don't need to have been the victim of an operation that went wrong either. You can sue the NHS if you have been the victim poor NHS dental treatment, a GP who has been struck-off or even as the result of physiological injury.

If you or a member of your family is unfortunate enough to be suffering from pain, injury or disability caused be medical negligence, or the trauma of an operation or birth that went wrong, our specialist solicitors will help you claim any compensation that you are entitled to and help you to sue the NHS.

Whether your claim is against a private or National Health Service professional, our specialist solicitors can help you obtain the maximum award.

At Smart Assist we have access to experienced medical specialists who can act as expert witnesses in a court case (although most cases do not go to court). Our specialist solicitors will collate all the necessary information and evidence to pursue your NHS medical negligence compensation claim to the best possible outcome.
