Scottish win the right to claim for asbestos injury, leaving the insurance sector furious

A new ruling form the Scottish Government giving those injured by asbestos to right to claim compensation, has left insurers across the UK furious.

In 2007 the House of Lords ruled that people exposed to asbestos could only claim compensation if the exposure had resulted in a physical problem, which was not obvious in many cases.

The new legislation from the Scottish Parliament means that people suffering from 'pleural plaques' can claim compensation. Asbestos campaigners are said to be ‘delighted’ by the ruling, as it is believed that pleural plaques can lead to serious illnesses such as cancer.
